Appellant, plaintiff below, appeals from an order granting the defendants motion to tax costs and attorneys fees and an order granting the defendants motion to stay the proceedings pending payment of the costs and fees. The sole issue raised on this appeal is whether the trial court erred in awarding attorneys fees to the defendant. We find that the trial court did so err and reverse that award of attorneys fees.
